MORATORIUM ON EVICTIONS FOR THE PURPOSE OF MAJOR REHABILITATION
(applies to units covered under the Rent Stabilization Ordinance)

 

On March 9, 2005, the City Council adopted Ordinance 175,544 implementing the Primary Renovation Program, effective May 2, 2005. Until that date, the moratorium on evictions for major rehabilitation remains in effect. The Primary Renovation Program (1) eliminates major rehabilitaion as a ground for eviction; (2) creates a new cost recovery program allowing landlords to incrase rents to pay for improvements to major building systems and the abatement of hazardous materials such as lead-based paint and asbestos; and (3) imposes tenant habilitability reuirements including temporary relocation when improvements to major building systems or the abatement of hazardous mterials is likely to temporarily affect the habitability of occupied units.

Historical Notes

A temporary moratorium on the eviction of tenants from rental units subject to the City's Rent Stabilization Ordinance for the purpose of major rehabilitation went into effect on July 30, 2002 and was expected to last six months. The moratorium was imposed using an interim control ordinance. On July 16, 2003, the City Council acted to extend the moratorium through October 21, 2003 (the 450th day from the initial imposition on July 30, 2002).

On October 17, 2003, the City Council acted to extend the moratorium for an additional 90 days.

City Council acted on Friday, January 16, 2004 to extend the major rehabilitation moratorium (Ord. 175359) through April 17, 2004 [Council File 01-0593-S1].

On April 12, 2004, the City Council extended the moratorium on the eviction of tenants for the purpose of major rehabilitation for an additional 90 days through July 10, 2004 [Ordinance 175893].

On July 7, 2004, the City Council extended the moratorium on the eviction of tenants for the purpose of major rehabilitation for an additional 90 days through October 12, 2004.

On October 12, 2004, the City Council extended the moratorium on eviction of tenants for the purpose of major rehabilitation for an additional 90 days through January 10, 2005.

Effective January 10, 2005, the City Council extended the moratorium on eviction of tenants for the purpose of major rehabilitation through April 9, 2005.

Effective May 2, 2005, major rehabilitation was removed as a legal reason for eviction, per Ordinance 176544, which establishes the Primary Renovation Program.
