City of Los Angeles, et. al., vs. AT&T; Los Angeles Superior Court Case No. BC414272 (May 21, 2009)

On May 21, 2009, the City of Los Angeles, Sacramento Metropolitan Cable Television Commission and City of El Segundo filed suit alleging various deficiencies in AT&T's provision of Public, Educational and Governmental Access under state law.

Los Angeles City Council Adopts Option One Recommendations on the City's Future PEG Access System on December 3, 2008

The Los Angeles City Council considered the Board of Information Technology Commissioners' and Municipal Access Policy Board's Report on the Future of PEG Access in the City of L.A., and adopted Option One of the recommendations and options for Public, Educational and Governmental Access commencing January 1, 2009.

Public Access Update 1/12/09

Until further notice, effective January 1, 2009, Channel 36, LACTAC, will be the sole provider of Public Access programming carriage in the City of Los Angeles. The City will be unable to provide Public Access studios due to changes in state law.  To learn more about this development, please read the BITC-MAPB report dated June 16, 2008, at the below listed link.

Anyone interested in providing Public Access programming content to Channel 36, LACTAC, must view their website first for their rules and procedures. Please note that Channel 36, LACTAC, will not amend their Rules and Procedures for Producers until after January 1, 2009. Further information will be available online at  LA36.

P.E.G. Community Meetings And Meeting Videos

Under new changes imposed by the State legislature and Governor, pursuant to Assembly Bill 2987 (DIVCA), the City has taken responsibility of the PEG Access operations and services offered in the City commencing on January 1, 2009. In preparation for the change over to the City-control and designation of the operations and management of PEG Access, the City held community meetings in March and April 2007. The purpose of the meetings was to obtain public opinion on the types of PEG Access services the public wanted provided by the City in the future, as well as to discuss the City's adoption of a new PEG Access structure under DIVCA. A report prepared by the Board of Information Technology Commissioners and Municipal Access Policy Board dated June 16, 2008 is provided in the attached link. ITA supported the findings and recommendations contained in that report.

New PEG Access System and In-Kind Services January 1, 2009

Pursuant to new State law, the City's incumbent cable TV providers, Time Warner, Cox Communications and Charter Communications, will no longer be obligated to provide free in-kind services such as free Internet and cable TV services to City departments, facilities, libraries, and schools, and operate and financially support Public Access TV studios. If it desires to continue utilizing those services, the new State law provides that the City of Los Angeles assume financial responsibility for all such services commencing January 1, 2009.

Current Public and Educational Access Facilities in the City of Los Angeles

Prior to the passage of DIVCA, the City of Los Angeles was divided into fourteen cable television franchise areas. Cable television companies will continue to provide free services in those former City franchise areas that offer Public and Educational Access channels, instructional classes, production facilities and portable production equipment until January 1, 2009. These facilities, as well as free services, will close on January 1, 2009.
