Child Care - Open Child Care Business

CITY OF LOS ANGELES CHILD CARE REGULATIONS: Family Child Care Homes, Large Family Child Care Homes and Child Care Centers.

FAMILY CHILD CARE HOMES
    Small Family Child Care Homes are permitted by right throughout the City of Los Angeles.

LARGE FAMILY CHILD CARE HOMES
    Large family child care homes located in the City of Los Angeles must:

  1. FIRE: Obtain a Fire Permit before a license is issued. The California Department of Social Services, Community Care Licensing Division will contact the City Fire Department to inspect the property and issue a Fire Permit (see regulations listed below).

  2. PLANNING: File a “Notice of Intention to Operate a Large Family Day Care Home” at the City Planning Department. No fee is required and potential provider may proceed upon filing form.

  3. CITY CLERK: A City of Los Angeles Business license is required. File at City Clerk’s Office. Initial fee for “Business Tax Registration Certificate” is required. Annual tax due is $1 per $1,000 of gross revenue.

    The City may restrict Large Family Child Care Homes in four areas: noise, traffic, parking and concentration. A Large Family Child Care Home may not be located within 300 linear feet of another Large Family Child Care Home or Child Care Center.

CHILD CARE CENTERS
    Child Care Centers located in the City of Los Angeles must:

  1. FIRE: Fire approval/permits are required. The City Fire Department must review and approve building plans as to fire and life safety (completed in the plan check and permit process, and Licensing process), and will inspect and approve the finished product (see Fire Regulations below).

  2. PLANNING: If the site is in an allowable zone (see attached chart) and no variances are required from applicable zoning ordinance (e.g. to exceed allowable fence height or reduce required amount of parking, or reduce sideyard or setback requirement, etc.) no special Planning Department approval is required.

    If the site is not in an allowable zone and/or needs variance from a particular zoning ordinance, the applicant must file an application for a Conditional Use Permit (C.U.P.). Listed below are the City of Los Angeles Planning Department locations where a C.U.P. form may be requested.

  3. BUILDING AND SAFETY: A Building Permit is required if: any construction is being done (new of modify) and is valued at more than $200; any of the work affects the structural stability of a building or public safety; if the work is being done to conform with Building Code requirements; or if the owner is requesting a change of occupancy. Permits are alos required for grading, electrical, plumbing, or mechanical work. Building Permits may be obtained at any of the following offices:

    With Change of Occupancy requests, the applicant may submit plans or request an Occupancy Survey for the Conservation Bureau. Applicants are required to meet all current codes including handicapped access and parking spaces.

  4. CITY CLERK: A City of Los Angeles Business license is required. File at City Clerk’s Office. Initial fee for “Business Tax Registration Certificate” is required. Annual tax due is $1 per $1,000 of gross revenue.
