The
ADA/Disability Mediation Program (ADA/DMP), City of Los Angeles,
Department on Disability, provides mediation services to persons
with disabilities or those whose conflicts involve a person
or persons with disabilities. Mediation services are also
provided to those (with a disability or not) who are presented
with disability questions. The ADA/DMP works in collaboration
with the City Attorneys Dispute Resolution Program,
and has special expertise in Americans With Disabilities Act
(ADA) mediation.

TYPES

MEDIATION
Mediation is a process for resolving conflict, whereby
disputing parties meet with a neutral third party, the
mediator, in an attempt to reach an agreement or a new
understanding of the conflict. If the parties are willing,
any conflict can be mediated. If you wish to have your
conflict mediated, the Department on Disability (DOD)
mediator will ask the other party to mediate. Even though
you may believe the other party will not mediate, they
often agree to participate. 75% to 85% of mediated cases
lead to agreements that satisfy both parties.

CONCILIATION
Conciliation is similar to mediation, except that it takes
place over the telephone and the neutral third party,
the conciliator, usually speaks with each disputing party
separately, when assisting the parties to reach agreement
or a new understanding.

FACILITATION
Facilitation is a process where parties, who need help
communicating, meet with a neutral third party, a facilitator,
as a way to avoid a conflict. For example, individuals
and employers often need assistance with discussions regarding
reasonable accommodations.

OPTIONS
COUNSELING
Parties should be free to choose whatever dispute resolution
process best meets their needs (mediation, conciliation
or facilitation). The DOD mediator will discuss the key
features of the parties dispute resolution options,
so that the parties are empowered to choose their most
appropriate options.

REFERRAL
Because we do not provide legal advice or represent either
party to the dispute, the ADA/Disability Mediation Program
provides referrals to legal service providers, government
agencies and ADA technical assistance programs.

TRAINING
The ADA/Disability Mediation Program can provide training
to the general public and professional mediators on mediation
and the Americans with Disabilities Act. The Program also
assists other mediators with disability disputes upon
request. Training includes addressing such issues as bias
awareness and communication with the disabled.
